Nicholas Johnson Interviewed on Oregon's EPR Rules, Challenges for Manufacturers

; Lardner LLP senior counsel Nicholas Johnson appeared on KPNW Radio’s “Wake up Call” to discuss Oregon’s Extended Producer Responsibility (EPR) recycling law and what ongoing challenges to the law mean for manufacturer compliance, enforcement, and potential fee recovery.
Johnson provided an overview of Oregon SB 582, the state’s Recycling Modernization Act which establishes Oregon’s EPR rules. He also reviewed penalties for noncompliance, exemptions based on producer size, and the broader legal process at play.
“There is a reason why laws like this are making my phone ring,” Johnson commented. “It’s a trifecta of circumstances and it’s an entirely new type of compliance obligation.”
