Assessing scrutiny from the Virginia Supreme Court on a major trade secrets jury award, he said that while he is curious about what the court decides regarding burden shifting, he is more interested to see what states with a larger trade secrets caseload do in response.
“I’m thinking about this from two perspectives,” Dharnidharka continued. “One, what does this state do? And then two, who follows it? Because if you think about most of the trade secrets claims that involve technology, those cases are mostly coming up in California, New York, Illinois, Texas, and Florida.”
